Learnopedia provides websites located at Learnopedia.co, all the content under these domains, certain related software, and its services (collectively the “Service”) to you (“User”) subject to the following Terms and Conditions, Acceptable Usage Policy, Privacy Policy and Service Level Agreement.

1. Accepting the terms

By using the Service, whether directly or indirectly, you agree to be bound by the latest amended versions of this Agreement, whether you are a “Visitor” (meaning you use the Service anonymously) or you are a “Member” (meaning you have registered in the Service). If you accept this Agreement, you represent that you have the capacity to be bound by it or, if you are acting on behalf of a company or entity, that you have the authority to bind such entity.

2. License to access the Service

Learnopedia grants the User a non-exclusive, non-transferable and limited license (with no right to sublicense) to access and use the Service in accordance with the terms of this Agreement.

Learnopedia reserves any and all rights not expressly granted in this Agreement, including, without limitation, any and all rights to the Service.

3. Accounts and passwords

If you are issued an account, you are responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password. Learnopedia reserves the right to, under its sole discretion, refuse service, suspend or terminate accounts, or otherwise restrict access to the Service.

4. Indemnity

You agree to indemnify and hold Learnopedia, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the Service, your connection to the Service, your violation of the Terms and Conditions, or your violation of any rights of another.

5. Abuse reports

Learnopedia unit is a pass-through network and, at most, caches content for a limited period in order to improve network performance. Learnopedia is not a hosting provider and has no way of removing abusive content on third party hosting services. Individuals or copyright holders concerned with content served through Learnopedia’s network may submit a complaint for investigation:

Accepted detailed information supporting your complaint as well as an affidavit attesting to its validity.

By submitting a complaint, you acknowledge that, at Learnopedia ’s sole discretion, copies of the complaint may be provided to the User, the User’s hosting provider, posted on Learnopedia ’s website, and/or provided to third party services.

6. No third party beneficiaries

You agree that, except as otherwise expressly provided in this Terms and Conditions, there shall be no third party beneficiaries to this Agreement.

7. Disclaimer of warranties and limitation of liability

The service is provided by Learnopedia on an “as is” and “as available” basis. Learnopedia makes no representations or warranties of any kind, express or implied, as to the operation and the effectiveness, content, materials of the service. You expressly agree that your use of the service is at your sole risk. To the full extent permissible by applicable law, Learnopedia disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchant ability and fitness for a particular purpose. In no event shall Learnopedia be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of the service, even if advised of the possibility of such damage.

8. Non-transfer-ability of accounts

You agree that your Service account is non-transferable except with the written consent of Learnopedia.

9. Time limitations for claims

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service must be filed within one year after such claim or cause of action arose or be forever barred.

10. User’s activity records

By using the Service, you consent to having your Internet Protocol address recorded and your activities monitored for security reasons.

11. 30-days Money Back Guarantee

You may request 100% refund for all standard Service payment plans during 30 days since first sign-up. Setup and other manual services, one-time add-ons, annual and custom plans – are not refundable.

12. Changes

Learnopedia may modify this Agreement. Any and all changes to this Agreement will be posted on Learnopedia.co. You are deemed to accept and agree to be bound by any changes to the Agreement when you use the Service after those changes are posted.
